After a one-day jury trial, Defendant was convicted of three counts of sexual abuse of a minor in the second degree. Defendant appealed, arguing that the district court abused its discretion when it admitted evidence that Defendant was in violation of his parole at the time of the offenses. The Supreme Court affirmed, holding that the district court did not abuse its discretion in admitting evidence relating to the terms of Defendant’s parole and his parole violations, as the district court considered the required Gleason criteria and had a legitimate basis for its conclusions.
